Please read these Terms of Service (“Terms”) carefully before using the CustomBoxesLabs website or placing an order with us. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (“Customer,” “you”) and CustomBoxesLabs (“we,” “us,” “our”). They apply to all visitors, users, and customers of the Site and our services. We reserve the right to update these Terms at any time. Continued use of the Site or services after changes constitutes acceptance of the revised Terms.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using our services on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Our Services

CustomBoxesLabs provides custom packaging manufacturing services, including but not limited to: custom mailer boxes, rigid boxes, folding cartons, kraft boxes, shipping cartons, and eco-friendly packaging. We provide 3D mockups, structural specifications, and print pre-press review as part of the quotation and order process.

We reserve the right to refuse service to anyone at our discretion and to discontinue or modify any service without notice.

3. Quotes and Orders

Quotes: All quotes provided by CustomBoxesLabs are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the specifications provided at time of request. Changes to specifications may result in revised pricing. A quote does not constitute a binding agreement to supply.

Order confirmation: An order is confirmed only upon receipt of your written approval (email confirmation, signed proof approval, or purchase order acceptance) and receipt of payment or agreed deposit. Production does not begin until both conditions are met.

Order changes: Changes to an order after production has commenced may not be possible and may incur additional charges. Contact us immediately if you need to modify an order in production.

Minimum order quantity: We have no minimum order quantity. You may order a single unit. Unit pricing varies by quantity as set out in your quote.

Note on prototypes: Single-unit prototype orders are produced at the quoted unit rate for that quantity tier. Prototype orders carry the same turnaround commitments as stated in your quote.

4. Artwork and Customer-Supplied Files

Your responsibility: You are solely responsible for the content, accuracy, and legality of all artwork, text, images, logos, and other materials you supply. By submitting artwork, you confirm that you own or have the right to use all content and that it does not infringe any third-party intellectual property rights.

File requirements: Artwork must be supplied in accordance with our print file specifications (available on request). We are not responsible for print quality issues resulting from low-resolution files, incorrect colour profiles, incorrect bleed, or other file preparation errors.

Proof approval: Where a digital or physical proof is provided, you must review and approve it before production commences. Your approval confirms that the proof is correct as presented. We are not liable for errors (including text errors, colour variations, or layout issues) that were present in an approved proof.

Colour reproduction: Printed colours may vary from on-screen representations. We print to industry-standard colour management processes. Exact colour matching is not guaranteed without Pantone-specified inks. If precise colour matching is critical, specify Pantone references in your order.

Prohibited content: We will not print materials that are unlawful, defamatory, obscene, or that infringe third-party rights. We reserve the right to decline any order on this basis without liability.

5. Production and Delivery

Lead times: Lead times are estimates from the date of artwork approval and payment confirmation. Standard lead times are 10–15 business days for printed orders and 7–10 business days for plain/unprinted orders. Lead times may vary during peak periods. We will notify you if your order is likely to be delayed.

Rush production: Rush production may be available at additional cost. Confirm rush availability at time of order. Rush orders are not guaranteed to be completed faster during production peak periods.

Shipping: Orders ship flat-packed to the address specified at time of order. Shipping costs are calculated and confirmed in your quote. Risk of loss transfers to you upon handover to the carrier.

Quantity variance: Custom packaging production may result in over-runs or under-runs of up to ±5% of the ordered quantity. You will be invoiced for the actual quantity shipped. This is standard industry practice for manufacturing runs.

Delivery claims: Damage or loss claims must be reported within 5 business days of delivery with photographic evidence. Claims submitted after this period may not be accepted.

6. Payment Terms

Payment in full: For new customers and orders under $5,000, payment in full is required before production commences.

Deposit: For orders over $5,000, we may accept a 50% deposit with the balance due prior to dispatch. Agreed payment terms are confirmed in your quote or order acknowledgement.

Accepted payment methods: Credit card, bank transfer (ACH/wire), and other methods as confirmed at time of order. Credit card payments may incur a processing fee as disclosed at checkout.

Late payment: Invoices not paid by the due date may incur late payment interest at 1.5% per month on the outstanding balance. We reserve the right to withhold dispatch of completed orders pending payment.

Currency: All prices are in US Dollars unless otherwise stated.

7. Returns, Reprints, and Refunds

Custom packaging is manufactured to your specific order and cannot be restocked or resold. As such, we do not accept returns except in the circumstances described below.

Manufacturing defects: If your order contains a manufacturing defect (a defect caused by our production process, not by your artwork or specifications), we will reprint the affected quantity at no charge. You must report the defect within 5 business days of delivery with photographic evidence of the issue and the packaging it arrived in.

Our error: If we produce your order incorrectly based on the specifications you approved (wrong dimensions, wrong quantity, wrong substrate) we will rectify the error by reprinting or refunding the affected quantity.

Customer error: We are not responsible for errors in approved artwork (including spelling mistakes, incorrect dimensions specified by the customer, incorrect colour references, or low-resolution file submission). If the product has been produced correctly to your approved specifications, we will not reprint or refund on the basis of customer error.

This is why we recommend ordering a prototype first. A single-unit prototype at your exact spec allows you to validate dimensions, print quality, and structural performance before committing to any production run. There is no minimum order and no setup fee for prototypes.

Refund processing: Where a refund is approved, it will be processed to the original payment method within 10 business days.

8. Intellectual Property

Your content: You retain all intellectual property rights in the artwork, logos, and other materials you supply. By submitting materials to us, you grant CustomBoxesLabs a limited, non-exclusive licence to use your materials solely for the purpose of fulfilling your order.

Our content: All content on the customboxeslabs.com Site — including text, graphics, logos, images, and software — is owned by or licensed to CustomBoxesLabs and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

Portfolio use: We may use images of packaging we produce (without your business name or confidential product information) in our portfolio, website, and marketing materials unless you request otherwise in writing at time of order.

Third-party rights: You indemnify CustomBoxesLabs against any claim, loss, or expense arising from your supply of materials that infringe third-party intellectual property rights.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of business, or loss of data, even if we have been advised of the possibility of such damages.
  • We are not liable for delays or failures caused by circumstances outside our reasonable control, including but not limited to supply chain disruptions, carrier delays, natural disasters, or industrial action.

Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Delaware.

Before initiating legal proceedings, you agree to contact us in good faith to attempt to resolve the dispute informally. We aim to respond to any dispute communication within 10 business days.
